Familia Torres Wine Club Membership Conditions
These conditions regulate membership of the Familia Torres Wine Club.
The Familia Torres Wine Club is a project of MIGUEL TORRES, S.A., with registered offices at c/ Miquel Torres i Carbó, 6, 08720 Vilafranca del Penedès (Barcelona) and C.I.F. A-08933251.
The Familia Torres Wine Club is a wine club that offers its members the opportunity to receive 1 (one) case of wine a quarter –4 (four) cases of wine a year– on payment of the corresponding fee, in accordance with the provisions of point 2 of these conditions.
Moreover, the members of Familia Torres Wine Club may enjoy other membership benefits, in accordance with the provisions of point 3 of these conditions.
You can join the Familia Torres Wine Club can be done by the following means:
- Offline form provided by the staff of Familia Torres Wine Club.
- Online form on www.torreswineclub.com.
Familia Torres Wine Club membership is managed exclusively online.
Members of Familia Torres Wine Club may choose from one of the following fees:
- Preferential Case: includes 4 (four) 75-cl bottles of wine (seventy-five centilitres) selected by Familia Torres Wine Club.
The wines chosen are from the Familia Torres Select range.
Each case is valued at between € 90 and €100 (between ninety and one hundred euros).
Members who chooses this option must pay a quarterly fee of between € 60 and € 70 (sixty euros and seventy euros). Specifically, the price will be determined quarterly from the sales price, before taxes, of the product selected by Familia Torres Wine Club. A discount of 15% (fifteen percent) will be applied to this amount.
- Collection Case: This case contains 2 (two) 75-cl bottles of wine (seventy-five centilitres) selected by Familia Torres Wine Club.
The wines chosen are from the Familia Torres Prestige range.
Each case is valued at between € 120 and € 140 (between one hundred and twenty and one hundred and forty euros).
Members who chooses this option must pay a quarterly fee of between € 90 and € 100 (ninety and one hundred euros). Specifically, the price will be determined quarterly from the sales price, before taxes, of the product selected by Familia Torres Wine Club. A discount of 15% (fifteen percent) will be applied to this amount.
- Collection and Preferential Cases: includes 6 (six) 75-cl bottles of wine (seventy-five centilitres) selected by Familia Torres Wine Club.
The selected wines are included in the following ranges:
- 4 (four) 75-cl bottles of wine (seventy-five centilitres) from the Familia Torres Select range.
- 2 (two) 75-cl bottles of wine (seventy-five centilitres) selected by Familia Torres Wine Club from the Prestige range.
Each case is valued at between € 210 and € 140 (between two hundred and ten and two hundred and forty euros).
Members who choose this option must pay a quarterly fee of the sum of the two cases (Preferential Case + Collection Case). Specifically, the price of the fee will be determined quarterly from the sales price, before taxes, of the product selected by Familia Torres Wine Club. A discount of 15% (fifteen percent) will be applied to this amount.
The products contained in the cases are in accordance with current Spanish legislation and the regulations applicable in Spain. Each product is also accompanied by an exact description of its main characteristics.
Third. Membership Benefits of the Familia Torres Wine Club
Members of Familia Torres Wine Club enjoy the following benefits:
- The quarterly shipments of the cases contain a gift, to be determined by Familia Torres Wine Club.
- 15% (fifteen percent) discount on the purchase of wines in shops and/or online stores managed by Familia Torres.
- 15% (fifteen percent) discount at the Masia Mas Rabell de Fontenac and La Vinoteca Torres de Paseo de Gracia restaurants in Barcelona.
- Special conditions for renting the Familia Torres venues for private events.
- Preferential access to the Experiencias Torres.
- Access to limited editions of bottles (old vintages, new vintages, large formats, climats...).
- Online consultations with the Familia Torres Wine Club sommelier.
- The Club wine: an exclusive wine for members of the Familia Torres Wine Club.
Fourth. Payment of fees.
Fees are charged to the card numbers that members provide in writing to Familia Torres Wine Club on registering.
However, members may change their card details at any time by sending an e-mail to email@example.com.
We accept the following credit cards: Visa, Visa Electron and Mastercard.
Credit card numbers are checked to ensure they are valid and are not blocked. This is done on the payment gateway of “La Caixa”.
In accordance with our secure payments policy, we inform you that "La Caixa" verifies all members’ bank details.
Familia Torres Wine Club will inform members that it will charge their credit cards with the fee 7 (seven) days in advance. Members receive notification of the charge by email.
Members’ accounts are charged within a maximum period of 7 (seven) days from the date of order. The order will be considered effective upon the payment centres confirming the agreement.
All purchase transactions take place within a framework of strict confidentiality and are encrypted using the SSL protocol over the payment gateway.
In this process, Familia Torres Wine Club reserves the right to ask clients to send (by fax or mail) a copy of both sides of their national identity document, as well as proof of residence, less than 3 (three) months old. No orders will be sent until these documents have been received and checked. The requested documents must be submitted within 6 (six) working days.
Fifth. Cancellation of fees.
If members no longer wish to pay a fee, they must notify Familia Torres Wine Club within 5 (five) days of the charge notification date provided for in the previous section of these terms and conditions by using the cancellation option in the “Subscription management” section of the www.torreswineclub.com website.
Users may only be authorized to cancel 2 (two) fees annually. If a user cancels more than 2 (two) fees with the year, Familia Torres Wine Club will automatically cancel said user’s membership of Familia Torres Wine Club.
Sixth. Processing membership cancellation in the Familia Torres Wine Club.
All members of Familia Torres Wine Club may cancel their membership. Unsubscribing must be done online, through the “Subscription management” section of the www.torreswineclub.com website.
The cancellation may be processed at any time. If the payment of a fee or a case has been processed and the case is being delivered, the provisions of conditions five and seven, respectively, shall apply.
Once the cancellation has been processed, all the benefits linked to the membership of Familia Torres Wine Club provided for in points 2 and 3 of these conditions will be cancelled.
Seventh. Shipping of the cases.
7.1. Shipping of the case.
The Torres Wine Club Family will send the case quarterly, shipping in March, June, September and December. The cases will be shipped during the last 15 (fifteen days) of the aforementioned months.
Delivery will be made to the postal address provided by members on registering at Familia Torres Wine Club.
However, members may change their shipping addresses at any time, provided that the shipment is not in progress, in Section XXXX of the www.torreswineclub.com website.
In accordance with the provisions of these conditions, members must pay the fee corresponding to the shipment in advance.
7.2. Order tracking. If members have any questions or queries from when they place their orders until they receive it, they can contact us by phone at XXXX and by mail at XXXX.
7.3. Problems with delivering the case.
If the member is not at the address provided to receive the case, it will be delivered to a family member or a person living at the same address. If delivery fails, the member will be notified with all the details of the shipment and the contact telephone number of the transport company to set a new delivery date.
If the member does not contact the carrier within 2 (two) days of the first attempt, the agency will contact the member to arrange a new delivery.
As soon as members receives their cases, they must:
- Check the goods received at the time of delivery.
- Report any anomalies on the delivery note, stating their complaint and sign the note.
- If the articles need to be returned to Familia Torres Wine Club, the transport company will contact the member to arrange the date and time of collection. The goods must be accompanied by the original delivery note.
If the delivery of the case is delayed or if it does not arrive at its destination, members can contact Familia Torres Wine Club by sending an e-mail to firstname.lastname@example.org, or by calling 93 817 73 09
If a case is returned because it could not be delivered (incorrect member's address, expired collection deadline...etc.) the member in question will be automatically notified by email. If said member does not contact Familia Torres Wine Club within 1 (one) month after the sending of the aforementioned email by Familia Torres Wine Club, the latter will proceed to cancel the membership in accordance with the provisions of these conditions.
7.4. General conditions for returns
In accordance with the provisions of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Act for the Defence of Consumers and Users, the members have a withdrawal period of 14 (fourteen) calendar days from the date of the charge for each quarterly fee, and must complete the withdrawal form in the "Subscription Management" section of the www.torreswineclub.com website where they can download the withdrawal form.
The right of withdrawal cannot be exercised when there is evidence that the case has been opened, handled or exposed to unsuitable conditions. The case must be returned properly protected and in its original packaging.
Familia Torres Wine Club will not accept packages without the sender's identification details (name, surname, address, order number). The corresponding quarter's fee will be refunded on return of the case.
This amount will be paid to members within a maximum of 7 (seven) days after receipt of the case at Familia Torres Wine Club’s premises. Refunds of amounts paid will always be made by the same means of payment used by the member.
In all cases, members will receive an email informing them of the refund.
As a general rule, the costs of returning cases are borne by members. Returns resulting from an error by the Familia Torres Wine Club or from a product defect are excluded from this case, and the provisions of clause 7.3 below shall apply.
Familia Torres Wince Club will not accept any exchange or refund unless we have received prior notification. Cash on delivery returns will not be accepted.
In accordance with banking legislation, no refunds can be made on expired credit cards. In this case, Familia Torres Wine Club reserves the right to ask the member for all the information necessary to make the corresponding refund.
7.5. Defective product.
At Familia Torres Wine Club, we regularly taste the products we deliver to our members and we have a high product rotation, which allows us to detect any anomaly. However, occasionally some bottles may not arrive in proper condition at their destination. In this case, we will replace it with another one free of charge, without prejudice to clause 5.1 above.
In this case, Familia Torres Wine Club undertakes to exchange the defective product for an identical one or to refund the amount of the fee, assuming the costs of return and subsequent shipping, if any.
Our shipping packaging is designed to prevent breakage and our partners are well aware of the fragility of the product, but some breakage may occur.
As soon as you receive your package, follow the steps below:
- Check the goods received at the time of delivery.
- Report any anomalies on the delivery note, stating the complaint or comments and sign the note.
Transport providers will not allow the return of merchandise members open the package in their presence, but members can check the outside of their cases and, if they detect wet or dampness, they should not accept the shipment. The shipping company will notify us of the incident and we will automatically send a new shipment at no additional cost.
In any case, the above guarantee is valid for a maximum of 2 (two) years, in accordance with current regulations. Without prejudice to the foregoing, and due to the nature of the product, Familia Torres Wine Club reserves the right not to accept the return of the product if it has not been kept in recommended storage conditions.
Similarly, members are aware of and accepts the risk that certain products, due to their characteristics, age or nature, may be affected quickly by external causes that are not attributable to Familia Torres Wine Club under any circumstances.
If the bottles received do not correspond to your fee, or the product is defective, simply send an email to email@example.com or contact us at 93 817 73 09, giving your details and those of your order and we will replace the order free of charge.
Clause 8. Modifications
The information contained on this website is current on the date of the last update. Familia Torres Wine Club reserves the right to update, modify or delete information on this website.
However, Familia Torres Wine Club reserves the right to make any changes and modifications it deems necessary at any time and may make use of this right at any time.
Familia Torres Wine Club reserves the right to unilaterally modify the membership conditions of Familia Torres Wine Club, as well as the other legal texts published on this website. Any changes to them will be announced accordingly, respecting the rights of consumers at all times. Amendments to the conditions of use will enter into force from the time they are published on this website.
If members do not agree with the changes made, they may cancel their membership of the Familia Torres Wine Club in accordance with the provisions of these conditions.
Clause 9. Protection of personal data
In compliance with the provisions of the Law on Information Society Services and Electronic Commerce, and the General Regulation on Data Protection (RGPD) and any other legislation in force that may be applicable to the protection of personal data, MIGUEL TORRES, S.A. informs you that your data will be processed as was specified at the time said details were provided.
This processing is legitimised by your consent.
Your data will not be passed on to third parties.
To exercise your rights of access, rectification, deletion, opposition, limitation of the processing and the portability of your data, as well as to revoke the consent given for the sending of commercial communications, or the consent to the processing of your data, you may write to C/ Miquel Torres i Carbó, nº 6, 08720 Vilafranca de Penedés (Barcelona) or send an e-mail with the reference "Personal Data" to the following address firstname.lastname@example.org. In both cases, you must provide a photocopy of your ID card or passport.
Clause 10. Registered Trademarks
All brands, logos and anagrams shown on this site are the property of MIGUEL TORRES, S.A. and/or other companies of the group to which they belong and/or of third parties from whom we hold the corresponding licence. The use without prior consent of any element belonging to Torres that is protected according to the law on industrial property is expressly prohibited. Especially, no trademarks, trade names, signs, names, logos, slogans or any type of distinctive sign belonging to Torres or third-party company may be used without the written permission of Torres.
Clause 11. Legal action
MIGUEL TORRES, S.A. and/or third-party licensors reserve the right to take legal action against members who violate or infringe these membership conditions of Familia Torres Wine Club, as well as any other rights of Familia Torres Wine Club.
The relationship between Familia Torres Wine Club and its members shall be governed by current Spanish legislation and any dispute with a particular member shall be submitted to the courts and tribunals of the member's domicile.
Clause 12. Resolution of conflicts online.
Regarding the resolution of consumer complaints online, Art. 14.1 of Regulation 524/2013 of the European Commission provides consumers with a platform for lodging complaints, which is available at the following link: http://ec.europa.eu/consumers/odr/
